The
purpose of the Sand Dollars Rewards Program is to obtain the names
and contact information of prospective purchasers. Any acquired
names and contact information may be used for the purpose of soliciting
sales of timeshare unit weeks. Such solicitation will only occur
in states where the timeshare project is registered or is exempt
from registration. The Sand Dollars Rewards Program is neither an
offer to sell nor is it a solicitation to purchase. This program
is offered only to persons subsequent to the closing of their purchase
of a timeshare unit week and is not made as an inducement in connection
with the solicitation of such sale.
You may provide us with the names of persons who
may be interested in a timeshare unit week and our representatives
will handle the rest. You are not authorized to present, sell, offer
to sell, or negotiate the sale of a timeshare unit week.
Referrals are required to attend a sales presentation
as part of a discounted vacation offer and must meet certain qualifications.
Qualified referrals are defined as follows: individuals or married
couples between the ages of 25 and 72 with a combined annual household
income of at least $40,000. If married, both husband and wife must
attend the sales presentation together. Previous participants, current
owners, employees of the developer and its affiliates are not eligible.
In order to receive Sand Dollars rewards, you must submit your referrals
to the Sand Dollars Rewards Program prior to your referral attending
the sales presentation. Notification of a referral less than 24
hours before the tour will not qualify for Sand Dollars Rewards.
You may apply "Sand Dollars" toward maintenance fees,
mortgage payments, club time or other resort amenities. In order
to apply Sand Dollars toward maintenance fees, the referring owner
must be current on their mortgage payments. Sand Dollars expire
24 months from date of issue.
You may provide as many referral names as you wish in a calendar year but your maximum credit cannot exceed twenty (20) qualified referrals per calendar year. For each qualified referral that purchases a timeshare unit week, your account will be credited in the amount of 250 Sand Dollars and a bonus of 250 additional Sand Dollars will be credited to your account should three referrals purchase within an eighteen (18) month period. Your account will be credited for a purchase after your referral has provided a full down payment and one (1) monthly mortgage payment has been made. Please allow approximately six weeks from the date of your referral’s purchase for your account to be credited with Sand Dollars. In the event of a referral being submitted by two different owners, only the owner who first submitted the referral will receive any Sand Dollars earned on that referral. Resale purchases made by you or your referrals are not eligible for rewards. Sand Dollars will only be awarded on the number of timeshare unit weeks purchased during their first sales presentation.
Due to various laws and regulations throughout the
United States, if your referral resides in a state where the timeshare
project is not registered or exempt from registration, we may not
be able to invite them to attend a sales presentation. Your state
of residence as reflected in The Ron Jon ®* Cape Caribe
Resort ownership file will determine the terms and conditions under
which you can participate. This program is not available to residents
of New York and New Jersey. Limitations may apply to residents of
Arizona, Connecticut, Illinois, Maryland, Ohio and Texas. Address
changes for participation in the Sand Dollars Rewards Program will
not be accepted. Sand Dollars may be subject to income tax liabilities.
In the case of fraud or abuse involving Sand Dollars Rewards, Cape
Caribe, Inc. will have the right to take appropriate administrative
and/or legal action and all accrued Sand Dollars will be forfeited
and the account cancelled. Cape Caribe, Inc.
retains the right to change, limit, modify or cancel program rules,
regulations, and reward levels at any time. This includes increasing
levels for rewards, changing rewards, adding black-out dates and
limiting room availability. In the event any of these conditions
occur you may not be able to obtain rewards. This Sand Dollars Rewards
Program is void where prohibited by law and may be terminated or
modified at any time without notice.
